Terms of Service

You must be at least 18 years old and able to form a binding contract to use Elegantarian. If you use the Platform on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms. You are responsible for all activity that occurs under your account and for keeping your login credentials secure.

Elegantarian gives fashion and beauty creators (“Curators”) tools to capture products, organize them into collections, attach affiliate links, and publish a hosted storefront at a subdomain such as yourname.elegantarian.com. We provide the software, hosting, and analytics. We do not sell products ourselves, take title to any merchandise, fulfill orders, or process consumer purchases.

Elegantarian does not manage, administer, or control your affiliate relationships. Any affiliate program, commission arrangement, or partnership between you and a brand, retailer, or affiliate network (each a “Brand Partner”) is solely between you and that Brand Partner. Elegantarian is not a party to those agreements, does not set or guarantee any commission, and does not collect, hold, or distribute your affiliate earnings.

You are solely responsible for:

• Enrolling in and maintaining good standing with each affiliate program or network you use;
• Creating, updating, and monitoring your own affiliate links, including replacing links that expire, break, or are deactivated by a Brand Partner or network;
• Ensuring your use of any link complies with the terms of the applicable Brand Partner and network; and
• Any tax, disclosure, or reporting obligations arising from your affiliate income.

You are responsible for the accuracy of the affiliate IDs, tracking parameters (query strings), and link rules you give us. Elegantarian adds them to your outgoing links exactly as you enter them. Tracking clicks, attributing sales, and calculating and paying commissions are done solely by the Brand Partner or affiliate network that manages your program. Elegantarian has no access to or visibility into that tracking, your sales, or your commissions, and makes no guarantee that any click or purchase will be tracked, credited, or paid. We keep your affiliate details private to your account, as described in our Privacy Policy.

Elegantarian is not responsible for lost commissions, unattributed sales, deactivated links, program terminations, or any dispute between you and a Brand Partner or network. Product data, pricing, and availability shown on your storefront originate from third-party sources and may be inaccurate or out of date; you are responsible for reviewing what you publish.

You retain ownership of the text, images, collections, and other materials you publish (“Your Content”). You grant Elegantarian a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute Your Content solely to operate, promote, and improve the Platform, including featuring storefronts in the Elegantarian showcase.

You are responsible for having all rights necessary to publish Your Content, including rights to any product imagery you capture and to every image you upload from your device, such as your logo, profile photo, and header images. If an image shows another person, you must have their permission to publish it. You must comply with all applicable advertising and consumer-protection laws, including the U.S. Federal Trade Commission’s endorsement guidelines and similar rules in your jurisdiction. This means clearly and conspicuously disclosing that your storefront contains affiliate links and that you may earn a commission from purchases. You are responsible for making these disclosures.

You may show videos on your storefront by connecting an Instagram professional account or a YouTube channel, or by adding videos yourself. Adding videos yourself covers links to videos on TikTok, Vimeo, or other platforms and videos you recorded on your phone and posted elsewhere. Connecting an account is optional.

• Only accounts you control. You may connect only an Instagram account or YouTube channel that you own or are authorized to manage. By connecting one, you authorize Elegantarian to access it as described in our Privacy Policy and to import and publish its videos to your storefront until you disconnect it.
• Your videos are Your Content. Imported videos and videos you add yourself are Your Content under Section 4. You are responsible for having the rights to everything they contain, including music, footage, and the likeness of anyone who appears in them. The affiliate and sponsorship disclosure rules in Section 4 apply to videos as well.
• Platform terms still apply. Your use of Instagram is governed by Instagram’s Terms of Use, and your use of YouTube by the YouTube Terms of Service. Videos from any platform play through that platform’s own embedded player and remain subject to its rules.
• Platforms can change. A video may stop appearing if it is removed, made private, or restricted on its platform, or if a platform changes or withdraws access to its service. If a connection is revoked or expires, we hide the videos imported through it so your storefront does not show broken players. Republish them after you reconnect. Elegantarian is not responsible for changes made by Instagram, YouTube, TikTok, or any other platform.
• Disconnecting. You can hide any video or disconnect an account at any time from your Videos page. Disconnecting deletes the access token and every video imported from that account.

You agree not to use the Platform to:

• Publish content that is unlawful, infringing, defamatory, deceptive, or that violates any third party’s rights;
• Misrepresent your relationship with any brand, or use a Brand Partner’s trademarks or imagery in a way it does not permit;
• Post counterfeit, unsafe, or prohibited goods, or content that is sexually explicit, hateful, or harassing;
• Upload or publish any image, video, or other media (including your logo, profile photo, or header images) that is illegal, sexually explicit, exploits or endangers minors, is violent, hateful, harassing, or deceptive, impersonates another person or business, or uses someone else’s photos, likeness, or trademarks without permission;
• Use affiliate IDs or tracking parameters that you are not entitled to use;
• Circumvent affiliate network rules, engage in cookie stuffing, or otherwise manipulate link attribution;
• Introduce malware, scrape the Platform without permission, or interfere with its operation or security.

We may remove content or suspend storefronts that we reasonably believe violate these Terms, without liability to you.

Paid plans (currently the Curator and Luxe tiers) are billed in advance on a recurring basis through our third-party payment processor, Stripe. By subscribing, you authorize us to charge the applicable fees to your payment method until you cancel. Fees are non-refundable except where required by law. You may cancel at any time from your account; cancellation takes effect at the end of the current billing period, and your paid features remain available until then. We may change our fees or plans on reasonable notice, effective at your next renewal.

Invitation trials. An invitation code from an existing Curator may start your plan with a free trial period (currently 30 days). A payment method is collected when you sign up, and the first fee for your plan is charged automatically when the trial ends unless you cancel before then. You can cancel during the trial at any time from your account page; if you do, nothing is charged and your storefront closes when the trial ends. One trial per person; we may refuse or revoke a trial that is obtained by misusing a code.

Referral reward. Each Curator has a personal invitation code. If, in the period before one of your monthly renewals, at least one person who signed up with your code pays their first subscription fee, that renewal is free. The reward applies to monthly plans only, is not paid in cash or credit, cannot be transferred, and requires that your own plan is active and not set to cancel. Invitations you send through the Platform are sent in your name; you may only invite people you know, and we may suspend invitations or the reward where we see misuse (including self-referral, fake accounts or unsolicited bulk invitations). We may change or end the referral reward on reasonable notice; months already earned are honored.

The Platform, including its software, design, logos, and the “Elegantarian” name, is owned by Ember Pulse Studios, LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms. You may not copy, modify, reverse-engineer, or create derivative works of the Platform except as expressly permitted.

The Platform links to and integrates with third-party services, including Brand Partners, affiliate networks, retailers, video platforms such as Instagram, YouTube, TikTok, and Vimeo, and payment and infrastructure providers. We do not control and are not responsible for those services, their content, or their practices. Your use of them is governed by their own terms.

The Platform is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Elegantarian does not warrant that the Platform will be uninterrupted, error-free, or secure, or that it will generate any particular level of traffic, sales, or affiliate income. We make no guarantee regarding the accuracy of product data or the performance of any affiliate link.

To the fullest extent permitted by law, Elegantarian and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost revenue, lost commissions, or lost data, arising out of or relating to your use of the Platform. Our total liability for any claim relating to the Platform will not exceed the greater of (a) the amounts you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

You agree to indemnify and hold harmless Elegantarian from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Platform, your affiliate or Brand Partner relationships, or your violation of these Terms or of any law or third-party right.

You may stop using the Platform and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Platform. On termination, your right to use the Platform ends and your storefront may be taken offline. Sections that by their nature should survive termination will survive.

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by posting the updated Terms with a new effective date. Your continued use of the Platform after the changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You agree that any dispute not subject to arbitration or small-claims resolution will be brought exclusively in the state or federal courts located in Delaware.
